1999 & 2000 Wild India Safaris: Limits of Rare Earth Explorations, Inc. Responsibility

INDEPENDENT SUPPLIERS Rare Earth Explorations, Inc., purchases transportation, hotel accommodations, restaurant and other services from various independent suppliers who are not affiliated with Rare Earth Explorations, Inc. in any way. Although it chooses the best suppliers available, Rare Earth Explorations, Inc. has no right to control their operations and CANNOT, THEREFORE, BE LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE which may occur due to (1) wrongful, negligent or arbitrary acts of omissions on the part of a supplier, its employees and others not under direct control of Rare Earth Explorations, Inc. or (2) defects or failures of any aircraft, vessel, automotive vehicle or other equipment or instrumentality under the control of independent suppliers. LODGES, HOTELS AND TENTED CAMPS Rare Earth Explorations, Inc. or its independent suppliers may find it necessary to make substitutions in the accommodations due to circumstances beyond the control of the company. Normally substitutions are of superior or equal quality. If a substitution of equal or superior quality cannot be secured, tour members will receive a refund for the difference. No charge will be made for upgrades. AIRLINES Rare Earth Explorations, Inc. has no control over any airline operations. The company is not responsible for schedule changes, delays and cancellations. Airline delays and extra expenses incurred because of airline delays are not the responsibility of Rare Earth Explorations, Inc. TRAVEL IN INDIA Services in India may not be as efficient as you are used to at home or in other countries you have traveled to. Rare Earth Explorations, Inc. is not responsible for the cleanliness of restrooms, delays in immigrations / customs, occasional equipment breakdowns, and other such events. OPTIONAL ACTIVITIES THAT MAY BE DANGEROUS You may choose to wander the cities that you visit on your own. Like anywhere in the world, there are dangers of robbery and personal injury associated with this. At some places you will visit on your tour, optional activities will be furnished by other independent suppliers who are not affiliated with Rare Earth Explorations, Inc. in any way. Should you elect to participate in such activities while you are on your tour, you are, of course, free to do so. However, you must understand that such participation will be at your own risk, and that Rare Earth Explorations, Inc. can assume no responsibility for your safety. Rare Earth Explorations, Inc. requests common sense and caution be exercised while visiting any of the cities and towns on the tour. Rare Earth Explorations, Inc. is in no way responsible for incidents or personal or public interaction occurring between a tour member and anyone you may meet in India. ACTS OF GOD AND THE LIKE Rare Earth Explorations, Inc. is not liable for acts of God, fire, weather, acts of governments or other authorities, wars, civil disturbances, riots, terrorist acts, strikes, thefts, pilferage, epidemics, quarantines, dangers incident to sea, land and air travel, and other similar acts of incidents beyond its ability to control. CANCELLATIONS AND REFUNDS All cancellations must be made in writing to Rare Earth Explorations, Inc. The per person cancellation charges on the land costs are as follows: Up to 90 days prior to departure/$250; 89-60 days/$750; 59-45 days/50%; 44-30 days/75%; 29-0 days/100% of tour cost. Trip cancellation insurance is strongly recommended. There is no refund should you leave the safari early for any reason. TRANSPORTATION ON SAFARI Rare Earth Explorations, Inc. cannot be held responsible should vehicle breakdowns or local conditions result in an occasional situation which could cause delays. SAFARI MEMBERS The tour operator assumes no responsibility for the attitudes or personalities of tour members. Usually positive and friendly people take safaris. Those who have serious health problems, physical or mental, are asked not to sign up for this tour. TRAVELER'S REPRESENTATIONS a) I certify that I have not recently been treated for, nor am I aware of, any physical or other condition or disability that would create a hazard to myself or other tour members. b) I understand that acceptance of the Registration Confirmation covering this tour and payment thereof is an acceptance by me of the tour conditions applicable to the tour. I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTAND THOSE CONDITIONS. c) I understand that Rare Earth Explorations, Inc. reserves the right to adjust U.S. Dollar prices, without notice, to reflect fluctuations in the Foreign Exchange Markets. d) I understand that Rare Earth Explorations, Inc. reserves the right to withdraw a tour or any part of it, to make such alterations in the itinerary and/or hotel accommodations as seems necessary or desirable, to refuse to accept or retain as a member of the tour any person at any time, and to pass on to tour members any expenditures occasioned by delays or events beyond its control (In case of an appreciable variation in cost in these, the right is reserved to make such adjustments to rates as necessary.) e) I HAVE READ, UNDERSTAND AND AGREE TO THE CONDITIONS SET OUT ABOVE UNDER THE HEADING "LIMITS OF RARE EARTH EXPLORATIONS, INC.
